In recent times, the FCC has over-extended its authority many times, and this time the DC Circuit was correct. The FCC is a “commission” and was originally set up as a “coordinator” with the goal of eliminating or mitigating RF interference. This agency has become bigger and bigger and has over-stepped its authority many times. In the instant case there is no law setting them up as the Internet Cop. Hopefully, the market will decide this issue, and if there is more competition, I believe this issue will be a moot.
